Federal Court Orders Freedom of Abrego Garcia from Immigration Detention
A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks lawful basis.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.
The situation stems from a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an error. After his repatriation to the United States to answer alien smuggling allegations, he was detained in immigration custody.
In her order, the judge noted that the government lacks a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

The court proceedings involve disputed assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.
He has also entered a not guilty plea to the conspiracy charges, which are part of a separate trial in the state of Tennessee.

The court, who was overseeing his challenge to deportation in a Maryland district court, ruled that he must now adhere to the terms of his bond from custody in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
